You can then ask the court for free Informal Dispute Resolution (mediation), ask for the court's Independent Medical Examiner process for medical disagreements, or file a petition with the court.

If your claim is denied or delayed in Nebraska

Who decides

Nebraska Workers' Compensation Court

First step

Contact the employer or insurer first (find the insurer with the court's Coverage Lookup or by calling the court's information line). You can then ask the court for free Informal Dispute Resolution (mediation), ask for the court's Independent Medical Examiner process for medical disagreements, or file a petition with the court.

Form
Petition (Nebraska Workers' Compensation Court)
Deadline

A petition must be filed within 2 years after the accident, or within 2 years after the last payment of compensation, unless you and your employer have agreed on the compensation. A Notice of Appeal must be filed within 30 days of the trial judge's decision.

Medical disagreements

Your employer or insurer may ask you to be examined by a doctor of its choice (not to treat you); unreasonably refusing can suspend benefits. For disagreements about your medical condition, either side can use the court's Independent Medical Examiner process. Disputes about changing doctors can go to free mediation, then to a judge.

Appealing the decision

Nebraska Court of Appeals.
